    If you criticize and critique a video game and show footage to illustrate your point it is protected by fair use. You seem to have little grasp what fair use means. We are not talking about putting up the gameplay with no added commentary or critique. What Nintendo is doing is demanding all footage fall under their own usages and throwing fair use out the window. Nintendo has the right to throw out any video without any reason, and can use this to censor criticism.

    What I don't understand is why your going out of your way to attack another persons livelihood based on an opinion about character licensing. Nintendo should be going after all the mobile games using Pokemon and other Nintendo based characters. Nintendo has never gone after the ROM hacking community, but they routinely go after any sort of 'fan fiction' that can generate revenue. I remember them shutting down a fan made project to remake Mario 1-3 in 3d using the n64 back in the day. 100% original meshes, music, and engine and the project got shut down by Nintendo due to 'quality concerns'. Now this was a fan game that was never to be sold, but it used the m word in the title and they got a cease and desist.

    Let me also use an example to counter the logic your using. Microsoft designed and coded the .NET framework that c#, java, and a host of other games and programming languages were coded on it, including all modern Nintendo products. Without .Net, we would not have any modern games at all, or developers would have a heck of a time figuring out how to talk to an OS. By your own logic Microsoft should own every product that uses the .Net framework. The wii u runs on this framework as well. That means Microsoft could potentially take the rights to all things on the internet that run on .Net because it runs on their own intellectual property. Why don't they? Because no one would ever try to develop for their systems if they pulled that crap. Developers and Microsoft live in a symbiotic relationship. Microsoft needs software to sell their OS, devs need tools to produce software; it is a win win.

    Now lets compare this to Nintendo. Nintendo needs exposure in the market to sell product. Sit in a GameStop one afternoon and count how many parents still ask for an x-cube. The fact is most people still can't tell the difference between a Wii and a Wii U. Youtubers need a product to show to get views, Nintendo needs exposure to sell product. Thus you tubers live in a symbiotic relationship. Both parties benefit, neither side loses. For every person like yourself who watched the pewds play a game and decided not to buy it, I'm thinking 10 people said 'looks cool' and bought the game.

    Technically/legally your correct except on the part I've highlighted which I'll get to in a minute.
     
    Nintendo have every legal right to issue copyright claims on YouTube videos with their material, as do Sony, Microsoft, EA, Activision, Ubisoft, Square Enix, Capcom, Bethesda and so on.  Most of these companies don't do it even though they have the Legal right to because.
     
    It's promotion for the product, even if the content creator is saying something negative.  There's no such thing as bad publicity, hell Hatred has gotten a fuck ton of publicity and will inevitably sell way more copies because of all the "negative" attention. It doesn't cost them any resources whereas advertisement on TV, billboards, conventions and so on does.  
    It's been said by myself and many others numerous times, this is where Nintendo has failed with the Wii U.  It's got great games, cool features, great peripheral design and backwards compatibility.  There are some things that are lacking like outdated graphical fidelity and 3rd party support but the main reason why it's the slowest selling gaming console since the Dreamcast and Nintendo's second worst commercially performing product post the 1983 crash is simple.....  PROMOTION!
     
    If you were to go to your local shopping mall and ask 100 random people if they would buy a Wii U I reckon at least 40% wouldn't know what a Wii U even was!  With the Wii they get lucky, the gimmick and low price sold a bunch of units which are now collecting dust but the casual "gimmick" market has moved on to Tablets and Smartphones.  This is why the highest levels of Management at Nintendo need to leave the company and let a younger generation take over, their vision of how to get unit's of the shelf is extinct.
     
    The obvious solution, YouTube!  If people could watch and share gameplay footage from the system more people would buy it! FACT!  But this is where the greedy old Dinosaurs of Nintendo stick their unwelcome outdated marketing strategies into the highlighted legal grey area.  Just because you have the legal right to enforce these type of policies doesn't mean it's beneficial to do so and the truth is for most gaming videos on YouTube they don't because it's under fair use and you don't need any permission to do that.  If a video gets flagged and the claim is not released then it's up to another level of legal enquiry to decide if the content is licensed under fair use or not. 
     
    The kind that almost certainly wouldn't be fair use would include posts including entire story elements of the game with no commentary, critique, analysis or any their own content and it by all rights it should be flagged.  That is not what most of the big players do, whether it's reviewing (AngryJoeShow, TotalBiscuit), Let plays with entertaining commentary (PewDePie) or general gaming news and stories with random gameplay in the background (ReviewTechUSA).  To be fair there are channels that are doing well with little to no copyrighted footage at all (boogie2988, AlphaOmegaSin) but still not a good idea to restrict by saying they can't.
     
    This is new media and it's being fully embraced by other platforms like PlayStation, XBox, PC Steam and Indys and it's at least part of the reason why these platforms and the companies that support them are doing so much better right now. Nintendo are stuck to the ways of old media and it's doing them more harm than anything else.  I see Nintendo going down the same road with the Wii U as Atari did with Jaguar and Sega with the Dreamcast unless they wake up and get with the frigging program.

    Tone would definitely a difficult thing to capture. Go too campy with bad child actors and it won't turn out well. Go too serious, then it's just another "gritty" dark fantasy movie and Lord knows we have too many of those these days.

    I think smash isn't in the list because of third party characters that they do not own the rights on and thus cannot stipulate what can and can't be done with the content. Same with bayonetta and hyrule warriors. Lana, cia, wizzro, and Volga are original characters for that game, thus Nintendo has no rights to those characters. I still think this whole thing is stupid and I dislike it, but just adding possible reasons for the action. Don't get me started on them asking channels to remove competitors content though.....

    Also to add to that, Game Freak reserves the right to not be on the Nintendo list as Nintendo doesn't own Game Freak, only publishes. That's why Game Freak games (Pokemon) aren't on the list.

    The scheme that Nintendo are trying set up is beyond idiotic.

    40-60/30-70 revenue split.
    Nintendo content only, even on already established channels.
    They reserve the right to censor or remove the video if it says anything negative.
    Can't split the revenue with another partner.
    They decide what games/content the video can include and it has been confirmed that not even all their own 1st party will be supported including Super Smash Brothers.
    What the hell are these morons thinking!

    So me crafting skits, editing video, shooting video, animating, editing sound, managing payroll for my contributors, creating costumes, coming up with criticisms and ratings as well as having to build a fan base isn't a real job? I did much less work when I worked at ATT and I'm sure that would have paid more. I'm not planning my channel around let's plays, and I plan on parodying or critiquing the content as well as doing collaborative podcasts. mystery science theater 3000 plus actual criticism will mark my channel, and if you have parodied anything, it takes just as much work as original creation(I've done both).
    I'm also currently designing a metroidvania style game bases in the egyptian mythos and let me tell you, it's much less work to put out that content than my current plans for the YouTube channel. Guess game design isn't a real job either because it is a lot simpler. That being said, just throwing up gameplay is not a job, but I'm going to do an actual show, not just gameplay.

    So uhh.. should we comment about joe's opinion on gamergate DURING HIS VIDEO in this thread... or the GG thread? I did in the youtube channel obviously, but I can't imagine any good will come of it... The stupid is strong there (on both sides...cuz it's youtube).
     
    edit: I didn't know about the mountain dew thing.. I mean I heard of it but didn't really know what the story was. I just wanna say though that I think the fact that a hired professional couldn't make a drama show out of a crew consisting of mostly gamers despite how much he tried with everyone's support only shows that gamers are generally the LEAST sexist,racist, overall bad group of people. Because you'd be damned blind if you haven't seen these kinds of shows succeed at causing drama in OTHER fields of interest.

    I probably won't upgrade until there are some useful improvements or it reduces the system resource footprint.
     
    That being said, the technology I'm interested in is Hallolens. I WANT WARHAMMER 40K WITH HALLOLENS. Seriously, to look at a table, and have it turn into a tabletop game would be epic. That and pokemon that we can actually see battle and collect and capture in the real world, and have our pokemon (or other critter) battle in the real world against other people over LAN. Also, can you imagine if someone made a megaman battlenetworkeskue game where you had to move between 9 squares on your side, and had to dodge attacks while using skills by aiming your arm or having them auto que and you firing by pulling a virtual trigger to attack enemies on the other 9 squares in augmented reality. Imagine facing other players in that very same game over WLAN. THAT makes me excited and I want to develop those games.
    Or can anyone say real world Megami Tensai game?
    That being said, I'm skeptical as heck about that trailer. But if it works as the hype trailer looks like, I WANT those games to happen.
